Uzbekistan may require banks to compensate fraud losses

Liability would apply when cybersecurity rules are breached or suspicious transactions are not stopped.

Uzbekistan’s Legislative Chamber is considering a bill that would require financial institutions to compensate affected customers, the chamber reported.

The bill is intended to strengthen cybersecurity and the system for countering offences committed in the digital environment. Lawmakers are reviewing it article by article at its second reading.

Several provisions were revised before the second reading to reflect proposals from lawmakers and lessons from law-enforcement practice.

Under proposed amendments to the Law on Payments and Payment Systems, banks, payment-system operators or payment organisations would compensate citizens for material losses caused by failures to comply with cybersecurity requirements or prevent suspicious transactions.

The bill also proposes administrative liability for transferring personal remote-government-service accounts or subscriber-device identification modules to other people for personal gain.

Unauthorised use of another person’s account or subscriber number would also carry administrative liability. The measures remain proposals and have not yet entered into force.
